Preamble

The Buy Cheap Luxury Goods Website includes (i) information sections and services offered to internet users regarding second-hand luxury goods and art and collectible objects, (ii) as well as a section dedicated to the sale by Buy Cheap Luxury Goods of such goods and objects.

This Website is managed by Buy Cheap Luxury Goods, whose offices and main showroom are located at 36-38 Boulevard Raspail, 75007, PARIS (hereinafter referred to as the Showroom), and which also has a space at BON MARCHE, 24 rue de Sèvres, 75007, PARIS.

The Buy Cheap Luxury Goods Website allows the online presentation to buyers (hereinafter referred to as Buyers) of second-hand luxury goods and art and collectible objects

• (i) owned by Buy Cheap Luxury Goods (hereinafter referred to as the Seller),
• (ii) as well as those owned by third-party proprietors of such goods/objects who have appointed Buy Cheap Luxury Goods for the purpose of selling them and collecting the price of said goods/objects on their behalf (hereinafter referred to as Principals),

which are offered for sale by Buy Cheap Luxury Goods (hereinafter referred to as the Product(s) and collectively referred to as the Catalogue) at their respective prices published online on the Buy Cheap Luxury Goods Website (hereinafter referred to as the Price(s)).

The Buy Cheap Luxury Goods Website facilitates the conclusion of sales contracts for the Products based on the published prices, which constitute fixed prices, without recourse to auctions on said Website.

It is specified that said Products, which are presented online by Buy Cheap Luxury Goods on the Buy Cheap Luxury Goods Website, may also, where applicable, be offered for sale in Buy Cheap Luxury Goods's Showroom.

Acceptance of these Terms and Conditions of Use and Sale of the Buy Cheap Luxury Goods Website by Principals constitutes a mandate granted to Buy Cheap Luxury Goods to operate transactions on the Buy Cheap Luxury Goods Website with Buyers for Products entrusted to Buy Cheap Luxury Goods by Principals for presentation for sale, not only on the Buy Cheap Luxury Goods Website under the conditions defined below but also, where applicable, in the Showroom.

Both internet users browsing the website of Buy Cheap Luxury Goods and Principals and Buyers defined above are hereinafter collectively referred to as Clients.

Article 1 Purpose

These Terms and Conditions of Use and Sale of the website operated by Buy Cheap Luxury Goods aim to define the conditions under which Clients are authorized to use the services offered by the website operated by Buy Cheap Luxury Goods.

Article 2 Definitions

Buyer: Refers to a Client who has indicated their acceptance of an offer for a Product presented on the Buy Cheap Luxury Goods Website.

Catalogue: Refers to all Products listed online for sale on the Buy Cheap Luxury Goods Website.

Certificate: Refers to the certificate of expertise issued by authorized persons at Buy Cheap Luxury Goods, certifying that the Product is compliant and not counterfeit.

Client: Refers, in singular or plural, to any internet user (including any Principal or Buyer) who consults the web pages of Buy Cheap Luxury Goods's Website to review, among other things, the information sections and service offerings on the Website, after accepting these General Terms and Conditions of Buy Cheap Luxury Goods. Commission: Refers to the remuneration received by Buy Cheap Luxury Goods from the sale price within the framework of the sales mandate entrusted to Buy Cheap Luxury Goods by a Principal for its services (inspection, technical and marketing work, creation and online publication of photographs and descriptions of the Product on the Buy Cheap Luxury Goods Website, etc.).This commission corresponds to 35.004% of the final sale price, VAT included (inclusive of applicable VAT).

Product Valuation Reports: The Buy Cheap Luxury Goods Website includes an "Expertise & Services" tab that provides access to analytical reports, which Clients can download by clicking on buttons such as "Search for a bag valuation" / "Search for a watch valuation" or directly from Product pages.The Buy Cheap Luxury Goods Website database is regularly updated.

Personal Data: Refers to data that, under the amended French Data Protection Act and Regulation (EU) 2016/679 of the European Parliament and Council dated April 27, 2016, allows identification, directly or indirectly, of a natural person.

Expertise: Refers to services provided by Buy Cheap Luxury Goods to Clients, particularly Principals who entrust a Product to Buy Cheap Luxury Goods for sale. These services are performed by authorized persons at Buy Cheap Luxury Goods and may involve collaboration with an authoritative Specialist chosen and approved by Buy Cheap Luxury Goods if necessary.
The initial inspection (before any potential referral to an authoritative Specialist) is based on photographs of Products and helps the Principal set an estimated value for their Product.
A final physical evaluation occurs after the Principal has sent or deposited their Product at Buy Cheap Luxury Goods: this is the Expertise intended for Buyers. This process ensures that the Product is not prohibited, described accurately according to its physical appearance, and sets its final valuation. These services are included in the Commission received by Buy Cheap Luxury Goods (i) under the sales mandate concluded with the Principal who entrusts a Product for sale and (ii) within the scope of a sale concluded between a Client and Buy Cheap Luxury Goods.

Product Page: Refers to the descriptive page of a Product offered for sale and published online on the Buy Cheap Luxury Goods Website. This page is entirely written by authorized persons at Buy Cheap Luxury Goods responsible for sales.

Principal: Refers to a Client who, after submitting a Product they own to Buy Cheap Luxury Goods for valuation and expertise, has entered into a sales mandate ("Mandate") with Buy Cheap Luxury Goods to entrust it with offering their Product for sale on the Buy Cheap Luxury Goods Website (and possibly in its Showroom), as well as collecting payment on their behalf from transactions.

Commercial Offer to a Client: Refers to the initial valuation of a Product communicated to a Client by Buy Cheap Luxury Goods following an inspection conducted by authorized persons at Buy Cheap Luxury Goods based on photographs and descriptions provided by the Client.
This valuation includes potential revision/repair costs aimed at enabling either (i) its offer for sale by Buy Cheap Luxury Goods as an agent for the Client subject to Commission payable by them (ii) or/and its direct purchase by Buy Cheap Luxury Goods at a different net price for the Client.

Data Subject: Refers to any individual identifiable directly or indirectly via an identifier (e.g., name, identification number, location data) or via one or more specific elements intrinsic to their physical, physiological, genetic, mental, economic, cultural, or social identity.

Transaction Price: Refers to the total price of a Product sold online payable by the Buyer to Buy Cheap Luxury Goods. It includes both the sale price of the Product and shipping fees.

Sales Offer Price: Refers to the price at which a Product is listed for sale. For Products belonging to Principals, this is determined by authorized persons at Buy Cheap Luxury Goods based on valuation estimates including potential revision/repair costs and validated by Principals for online listing under their Mandate with Buy Cheap Luxury Goods. This Sales Offer Price forms the basis for calculating Buy Cheap Luxury Goods's Commission.

Product(s): Refers collectively to Products owned either by Buy Cheap Luxury Goods or Principals that are offered for online sale on the Buy Cheap Luxury Goods Website.

Compliant Product: Refers to any Product that conforms with its description as provided by authorized persons at Buy Cheap Luxury Goods in its online sales offer.

Prohibited Product: Refers to any product originating from fraudulent sources, counterfeit items prohibited from sale, contrary to public decency, or non-compliant with legal or regulatory provisions. This includes unauthorized copies constituting counterfeit products under intellectual property law.

Processing: Refers to any operation or set of operations performed using automated means applied to personal data or sets thereof.

Showroom: Refers to premises located at 36-38 Boulevard Raspail, Paris 7th arrondissement where Buy Cheap Luxury Goods receives buyer and seller clients on appointment.

Website: Refers to the website managed by Buy Cheap Luxury Goods accessible at https://buy-bag.cn intended for online presentation of Products offered for sale along with the publication of their prices and other services provided by Buy Cheap Luxury Goods.

Seller: Refers to Buy Cheap Luxury Goods offering online sales of its own Products acquired from Clients (at net prices reflecting fees incurred during valuation and expertise services performed by Buy Cheap Luxury Goods).

Article 3 Process for Estimation and, where applicable, Online Sale on Behalf of a Client or Offline Sale to Buy Cheap Luxury Goods of the Client's Product

3.1 Initial Presentation of a Product by a Client to Buy Cheap Luxury Goods: The Client submits a Product to Buy Cheap Luxury Goods for an Expertise. To do so, they must complete the estimation request form (available on the Buy Cheap Luxury Goods Website) for the Product they wish to have appraised.
At least two (2) photographs are required for Buy Cheap Luxury Goods to examine the Product promptly and under optimal conditions (prior to any potential referral to an authoritative Specialist in the field).

The Client may also directly contact Buy Cheap Luxury Goods by telephone at +33 1 46 34 35 30 or via email at contact@collectorsquare.com. In cases involving inventory of collections, authorized persons at Buy Cheap Luxury Goods may travel to the Client's residence or another location of their choice to conduct the Expertise directly.

3.2 Initial Examination of the Product: Authorized persons at Buy Cheap Luxury Goods perform an initial examination of the Product submitted by the Client within two (2) business days following submission of the estimation request form and enclosed photographs. If the Product conforms to the estimation request form provided by the Client, this initial examination is immediately followed by a Commercial Offer tailored to market conditions and the specific characteristics of the Client's Product.

3.3 Possible Options for the Client: Buy Cheap Luxury Goods's Commercial Offer is sent to the Client via email.

The deposit slip (i.e., the pre-filled deposit form that must be returned signed by the Client upon (i) shipment or (ii) delivery of their Product to Buy Cheap Luxury Goods) is sent along with a shipping label after the Client accepts the Commercial Offer.

Buy Cheap Luxury Goods's Commercial Offer may include two distinct proposals: (i) an offer for online sale by Buy Cheap Luxury Goods as an agent for the Client/Principal (consignment sale), subject to remuneration payable by them to Buy Cheap Luxury Goods; and/or (ii) an offer for direct purchase of the Product by Buy Cheap Luxury Goods at a different net price for the Client (offline sales contract).

The Client may accept or decline one or both conditions proposed by Buy Cheap Luxury Goods for selling their Product.

3.4 Possible Methods for Agreement and Delivery of the Product to Buy Cheap Luxury Goods

3.5 Refusal by the Client: The Client may refuse to entrust the Product to Buy Cheap Luxury Goods after receiving their Commercial Offer (as defined in Article 3.3 above). In such cases, the process ends here, with the initial examination remaining free of charge.

3.6 Physical Examination as a Condition for Confirmation of the Commercial Offer and Conclusion of the Subsequent Contract: Upon receipt of the Product, authorized persons at Buy Cheap Luxury Goods conduct a physical examination of the Product to confirm their estimation and the sales conditions proposed by Buy Cheap Luxury Goods for concluding a Sales Mandate or a Sales Contract with the Client. At this stage, the Client must provide a copy of their National Identity Card or passport (excluding any other document) and their bank account details (RIB) to Buy Cheap Luxury Goods.

3.7 Marketing and Technical Description Following Contract Conclusion (Mandate or Sales Contract) with the Client: Once the Sales Mandate or sales contract is signed by the Client, Buy Cheap Luxury Goods proceeds with technical and marketing tasks for listing the Product online. Authorized persons at Buy Cheap Luxury Goods draft a detailed description of the Product (characteristics, history, condition report, etc.) and organize a photography session to present the Product.

Purchase Validation and Retention of Ownership: When a Buyer purchases a Product listed online, purchase validation occurs only after Buy Cheap Luxury Goods has delivered or handed over the Product following receipt of payment, once Buy Cheap Luxury Goods has been able to check the security of the transaction and validate the payment.

The sale is deemed completed only upon delivery or handover of the Product to the Buyer. Until such delivery or handover, ownership remains with its original owner (Buy Cheap Luxury Goods as Seller or Principal).

For Products listed online under a Sales Mandate from their owner, payment of the Transaction Price by the Buyer to Buy Cheap Luxury Goods signifies acceptance of the Principal's offer.

The Buyer acknowledges that their acceptance is based solely on the description provided in the sales listing, subject only to issuance of an Expertise Certificate prepared by authorized persons at Buy Cheap Luxury Goods and attached to the invoice. This acceptance constitutes a firm commitment under defined terms.

After Buy Cheap Luxury Goods receives payment for the transaction as outlined in this Article 3.8., shipment is arranged according to conditions described in Article 3.12 below.

3.9 Payment of Price Subject to Buyer's Right of Withdrawal: For Products listed online on Buy Cheap Luxury Goods's Website: (i) under a Sales Mandate from their owner (Principal), or (ii) owned by Buy Cheap Luxury Goods (Seller),Buy Cheap Luxury Goods may remit payment to the Product's owner only after confirming that a non-professional Buyer has not exercised their right of withdrawal.

Unless exercised within fourteen (14) calendar days following receipt by the Buyer, payment is made: (i) To Principals after deducting Commission, potential revision/repair costs, other services and prepaid shipping fees specified in the Commercial Offer and Sales Mandate; or (ii) Retained by Buy Cheap Luxury Goods as Seller after expiration of withdrawal rights within twenty (20) business days following receipt by Buyer.

3.10 Consequences of Withdrawal – Return of Unsold Products – Exceptions: If a Buyer exercises their right of withdrawal, returned Products are relisted for sale. However, if customized at Buyer’s request (engraving, resizing, transformation), withdrawal rights do not apply.

3.11 Retention of Ownership and Discharge for Buy Cheap Luxury Goods: For Products listed online under a Sales Mandate from Principals, full ownership remains entirely with Principals until completion of transactions; Buy Cheap Luxury Goods acts solely as an agent mandated by Principals and Buyers for transaction execution. Execution of these mandates constitutes discharge for Buy Cheap Luxury Goods in its capacity as agent.

In the case of a Product placed online on the Buy Cheap Luxury Goods Website by Buy Cheap Luxury Goods, in its capacity as Seller, Buy Cheap Luxury Goods also retains full ownership of its Product until the transaction is completed.

3.12 Shipping to the Buyer – Return – Product Restitution:

3.13 Lack of Buyer: Under a Sales Mandate, if a Product entrusted by its owner to Buy Cheap Luxury Goods fails to find a buyer under the conditions specified in the Sales Mandate after ninety (90) days of being listed online, Buy Cheap Luxury Goods may propose a review of the initial sale price to the Principal. With their consent, Buy Cheap Luxury Goods may apply a markdown to the originally presented price. The new price will be displayed on the website and reflected in both the online sales catalog and product pages to expedite the sale of the Product.

If the Product remains unsold under these conditions after ninety (90) days from its initial listing and the Principal does not agree on the possibility of a price review, they may immediately retrieve their Product. Upon request, it will be shipped back at no cost to them by Buy Cheap Luxury Goods.

Note: If Buy Cheap Luxury Goods informs the Principal via email that their Product has been returned and subsequently re-shipped but cannot be delivered and is returned again to Buy Cheap Luxury Goods, and if no response is received from the Principal regarding a registered letter within one year from its issuance, the returned Product will be deemed abandoned, and Buy Cheap Luxury Goods may declare ownership of it.

Article 4 Rights and Obligations of Buy Cheap Luxury Goods

4.1 Delivery by Buy Cheap Luxury Goods: Buy Cheap Luxury Goods may own some Products listed for sale on its Website. Regardless of ownership (Buy Cheap Luxury Goods or Principal), Buy Cheap Luxury Goods is solely responsible for fulfilling its obligation to deliver purchased Products. It commits to sending carefully packaged Products at the Buyer's expense.

4.2 Mandatory Internal or External Expertise: Buy Cheap Luxury Goods guarantees to expertise all Products listed on its Website, ensuring compliance. For Products listed under a Sales Mandate, Buy Cheap Luxury Goods is authorized by Principals to conclude appraisal contracts with Specialists chosen by Buy Cheap Luxury Goods if necessary.

4.3 Discretion in Accepting Products: Buy Cheap Luxury Goods reserves the right to accept or refuse any Product proposed for sale on its Website by a Principal.

4.4 Handling Complaints: Buy Cheap Luxury Goods commits to addressing complaints related to sales within four (4) business days.

4.5 No Guarantee of Sale: Buy Cheap Luxury Goods cannot guarantee that a Product proposed by a Principal under a Sales Mandate will not be returned or that a Buyer will not exercise their right of withdrawal.

4.6 Authority to Suspend Operations: In cases where Clients fail to comply with these Terms and Conditions, Buy Cheap Luxury Goods reserves the right at any time to withdraw Products from sale or suspend payments due to Principals until disputes are resolved. This right also applies if doubts arise post-Expertise without any claims by the Principal being admissible against Buy Cheap Luxury Goods.

4.7 Confidentiality of Transactions: Buy Cheap Luxury Goods guarantees confidentiality regarding Clients' personal data and commits not to disclose it except: (i) For any documents relating to the Product, identifying the Client who commissioned Buy Cheap Luxury Goods to sell its Product or sold it to Buy Cheap Luxury Goods, the delivery of which to the Buyer has been authorised by said Client; (ii) In response to judicial or regulatory authorities' requests, particularly in cases involving suspected criminal offenses.

Article 5 Rights and Obligations of Clients

5.1 Access to the Buy Cheap Luxury Goods Website: Upon registering with Buy Cheap Luxury Goods, Clients receive a unique identifier (their personal email address) and a strictly personal access code, which they agree to keep confidential. Registered Clients are solely authorized to use their account on the Buy Cheap Luxury Goods Website with their identifier and personal access code. Clients commit not to offer access of their identity or pseudonym to the Buy Cheap Luxury Goods Website to any other person. If Clients become aware of unauthorized access to their account, they will inform Buy Cheap Luxury Goods immediately and confirm this information in writing.

5.2 Single Account Unless Express Authorization: If Clients create or use accounts other than the one initially created under their personal email address by registering another email, they agree to inform Buy Cheap Luxury Goods via email to allow for account consolidation and deletion of obsolete accounts. Creating or using new accounts under their own or third-party identities without prior authorization from Buy Cheap Luxury Goods may result in immediate suspension of the Client's account and associated services.

5.3. Access Code as Evidence: In the event of a transaction dispute, Clients agree that production by Buy Cheap Luxury Goods of records on its servers concerning use of the Buy Cheap Luxury Goods Website, particularly the Client's personal access code, shall prevail.

Article 6 Specific Obligations of Principals contracting with Buy Cheap Luxury Goods for the sale of Their Products by Buy Cheap Luxury Goods on the Buy Cheap Luxury Goods Website

6.1 Ownership Status of Products Sold by Principals: Principals undertake that each Product offered corresponds to a tangible item under their full and unrestricted ownership and with the capacity to sell, available immediately, in their possession, and not meeting the definition of a Prohibited Product.

6.2 Product Description by Principals: Principals commit to describing Products for Expertise according to criteria established by Buy Cheap Luxury Goods in its estimation request form and to upload at least two (2) photographs of the Product offered for sale. The Product description must match its actual characteristics. Principals will specify: the product name, its features, brand, and condition based on the scale provided by Buy Cheap Luxury Goods (as detailed in the online estimation request form).

6.3 Truthfulness of Description: Principals are solely responsible for accurately informing authorized persons at Buy Cheap Luxury Goods responsible for Product estimation and expertise about the essential characteristics of the Product for sale on the Buy Cheap Luxury Goods Website, through the form accompanied by photographs submitted to Buy Cheap Luxury Goods.

Principals agree to perform all validations, verifications, and provide necessary details so that the description and form elements are truthful and do not mislead authorized persons at Buy Cheap Luxury Goods.

This initial examination does not bind Buy Cheap Luxury Goods. In the event of errors or inaccuracies in the description, and following visual Expertise, authorized persons at Buy Cheap Luxury Goods may propose a sale price different from that resulting from the initial examination or refuse to offer the Product for sale. No claim from Principals will be admissible by Buy Cheap Luxury Goods in this regard.

6.4 Irrevocable Mandate Except in Case of Withdrawal from a Remotely Concluded Mandate: Once Principals accept the offer transmitted by Buy Cheap Luxury Goods after visual Expertise, they agree to respect the irrevocable duration of ninety (90) days from the Product's listing date, as provided by the Mandate entrusted to Buy Cheap Luxury Goods.

However, non-professional Principals who have not contractually waived the right of withdrawal under Article L221-18 of the Consumer Code in their remotely concluded mandate with Buy Cheap Luxury Goods to benefit from its services (as described in Article 8.6.2 of these Terms) may exercise this right within fourteen (14) calendar days from the conclusion of the Mandate.

6.5 Exclusion of Prohibited Products: Principals are prohibited from offering for sale or allowing the sale of Products that are Prohibited. They agree to inform Buy Cheap Luxury Goods immediately if they discover such Products listed online.

Buy Cheap Luxury Goods reserves the right to immediately suspend a Principal's account and notify competent authorities of any offer for sale or attempt to offer for sale Prohibited Products on its Website.

6.6 Additional Obligations for Professional Principals: Principals acting professionally as agents of a company must identify themselves to Buy Cheap Luxury Goods in this capacity by providing a recent (less than three months old) extract from the KBIS register no later than upon signing the Mandate. Throughout the Mandate's duration, Principals agree to promptly communicate any updated KBIS extract to Buy Cheap Luxury Goods upon any change to information contained therein.

Buy Cheap Luxury Goods reserves the right not to contract with a professional Principal.

Buy Cheap Luxury Goods reminds professional Principals of their obligation to comply with laws and regulations regarding professional distance selling activities.

Professional Principals must ensure compliance with social and tax reporting obligations.

6.7 Financial Provisions

Article 7 Specific Obligations of Buyers

7.1 Identity Validation of Buyers: Buy Cheap Luxury Goods verifies the Buyer’s identity (ID card or passport) and requires them to sign a withdrawal receipt when collecting their purchased Product at the Showroom. Additionally, Buy Cheap Luxury Goods may, exceptionally and as part of efforts to combat potential fraud, request further validation of the Buyer’s identity. If the Buyer fails to provide requested information for identity validation, Buy Cheap Luxury Goods reserves the right to cancel the Transaction initiated by the Buyer.

7.2 Commitment to Compliance with Laws and Regulations: The Buyer commits to adhering to all laws and regulations related to acquiring goods of any kind. Furthermore, Buyers may be required to pay taxes or customs duties in cases of export outside the European Union.

Article 8 Complaints, Right of Withdrawal, and Mediation

8.1 General Complaints: Any complaint regarding a Product, excluding exercising withdrawal rights detailed in Article 8.6 below, must be submitted by the Buyer within a maximum period of one month from its receipt by email or registered letter with proof of receipt addressed to Buy Cheap Luxury Goods’s competent services.

Unlike withdrawal rights subject to a fourteen-day period without justification, complaints must be detailed and clearly state reasons for dissatisfaction.

Buy Cheap Luxury Goods commits to addressing complaints promptly and on a case-by-case basis with an aim to best satisfy Client sellers’ interests.

The Client seller must act diligently in resolving complaints and cooperate with Buy Cheap Luxury Goods’s services by providing necessary documentation for complaint processing.

8.2 Repeated Complaints: In cases where repeated complaints from a single Client are deemed unjustified, Buy Cheap Luxury Goods reserves the right to close that Client’s account.

8.3 Complaint Regarding Non-Receipt of Ordered Product:

8.4 Complaint Regarding Non-Conformity: Completion of sales is contingent upon issuance of an Expertise Certificate redacted by authorised personnel at Buy Cheap Luxury Goods alongside an invoice certifying that the Product is not prohibited.

However, if non-conformity is identified by authorized personnel at Buy Cheap Luxury Goods, reimbursement of the Transaction Price will be issued after return of the product and verification confirming it is indeed the same product and notification provided to its Principal. Should the Principal contest this assessment, they must provide all relevant documents supporting their position.

8.5 Complaint Regarding Hidden Defects: In cases where hidden defects are discovered, Buyers must submit their claims within the appropriate deadlines and procedures set forth under Articles 1641 et seq. of the French Civil Code.

8.6 Right of Withdrawal: The right of withdrawal may only be exercised by the non-professional Buyer, as well as the non-professional Principal, who entered into a contract with Buy Cheap Luxury Goods remotely (outside the premises), within a period of 14 (fourteen) clear days running from:

• (i) the receipt of the Product by the non-professional Buyer (Article 8.6.1 below),
• (ii) the conclusion of a Mandate contract with Buy Cheap Luxury Goods by the non-professional Principal, unless contractually waived, as detailed in Article 8.6.2 below.

If the deadline falls on a Saturday, Sunday, or public holiday, it is extended to the next business day.

8.7 Product Return and Costs

In cases of approved complaints and/or withdrawals, Products must be returned unused and complete in their original packaging with all accessories and documents, labels and seals properly affixed, in packaging identical or similar to that used during shipment within a maximum period of 14 (fourteen) days from the complaint approval notification or the withdrawal submission.

In all cases, Products must be returned in identical condition as when shipped. Return shipping costs are borne by Buyers unless there is non-conformity or hidden defects; in such cases, costs are borne by Principals if they are Client sellers of disputed Products.

Any taxes or customs duties paid by Buyers remain their responsibility. Presentation photos available on the website may serve as references in case of disputes.

The right granted to consumer Buyers to refer a dispute to a consumer mediator can only be exercised after a prior written and motivated approach to Buy Cheap Luxury Goods (via email at contact@collectorsquare.com or by mail to 36-38 Boulevard Raspail – 75007 Paris) in an attempt to resolve the dispute. Article 9 Liability

9.1 Guarantee by the Principal and the Client Selling a Product to Buy Cheap Luxury Goods Regarding Their Rights Over the Product

In cases where (i) a Sales Mandate has been concluded with Buy Cheap Luxury Goods or (ii) a sales contract has been entered into between a Client seller and Buy Cheap Luxury Goods, the Client contracting with Buy Cheap Luxury Goods for their Product(s) declares and guarantees that they have the right to transfer ownership of the Product(s) sold, that it/they have not been previously sold, pledged, mortgaged, or otherwise encumbered or assigned in favor of a third party, and that the transaction does not infringe upon any third-party rights. The Client attests that the sale of the Product by Buy Cheap Luxury Goods (i) or to Buy Cheap Luxury Goods (ii) complies with applicable legal rules, particularly with respect to Intellectual Property Law and any specific regulations.

The Client guarantees and indemnifies Buy Cheap Luxury Goods upon first request against any damages incurred by Buy Cheap Luxury Goods and against any liability actions brought against Buy Cheap Luxury Goods based on an infringement of any third-party rights. In cases of proven fraud (e.g., counterfeit products, stolen goods, illegal importation), Buy Cheap Luxury Goods will provide all necessary information, including personal data, to competent authorities responsible for investigating such frauds and offenses.

9.2 Moderation

Buy Cheap Luxury Goods cannot be held liable for offensive, defamatory, or otherwise unlawful comments posted online by a Client.

Upon becoming aware of inappropriate content, Buy Cheap Luxury Goods will take steps to have it removed.

9.3 Absence of IT Warranty

Except in cases of fault on its part, Buy Cheap Luxury Goods cannot be held liable for any damage suffered by a Client, including but not limited to loss of business or information. Buy Cheap Luxury Goods shall not be held responsible for potential malfunctions, failures, delays, or interruptions in internet access or other events attributable to its partners or suppliers.

Article 10 Termination

10.1 Termination Option for the Mandate by the Principal and by Buy Cheap Luxury Goods

The Sales Mandate concluded between the Principal and Buy Cheap Luxury Goods under these General Terms of Use for sales services is an open-ended contract. However, it is noted that the commitment made by the Principal who has accepted the Product presentation offer as defined therein is irrevocable for 90 (ninety) days from the date of online listing of the Product unless an agreement between the Parties occurs during or at the end of this 90-day period regarding modified presentation of the Product.

After this period, the Sales Mandate may be terminated at any time by Buy Cheap Luxury Goods with justified notification or by the Principal without specific reason through simple notification or by activating the "Terminate Your Contract" module online.

10.2 Termination Option by Buy Cheap Luxury Goods in Case of Breach of Obligations by a Client

In cases where a Client fails to meet one of their obligations—such as listing counterfeit items for sale, creating multiple accounts, payment fraud attempts, attempted scams, or other criminal offenses—Buy Cheap Luxury Goods reserves the right to suspend the Client’s account without prejudice to compensation for any damages suffered by Buy Cheap Luxury Goods; in such cases, the Principal cannot claim reimbursement for any costs they may have incurred.

Article 11 General Provisions

11.1 Changes to the General Terms of Use and Sale

Buy Cheap Luxury Goods reserves the right to modify these General Terms based on the evolution of its offerings and market conditions. Any changes will take effect immediately for online offers once Clients are informed by any means chosen by Buy Cheap Luxury Goods (e.g., notification by newsletter, email, etc.). These changes will not apply to transactions already in progress at the time of their implementation.

Occasionally, Buy Cheap Luxury Goods may change its codes, phone numbers, discontinue numbering, or interrupt services for operational, maintenance, emergency, or force majeure reasons.

11.5 Miscellaneous

Article 12 Governing Law and Jurisdiction

12.1 Any dispute with a Client acting in a professional capacity arising from interpretation and/or execution is subject to the jurisdiction of the Commercial Court of Paris.

12.2 For disputes with non-professional Clients, they acknowledge that Buy Cheap Luxury Goods’s services are performed in Paris.
